Another Dubya "I Told Ya So"
If, of course, he was at all petty, much less anywhere near as petty as his misbegotten successor - who is the only homo sapiens in the country (other than Eric The Red) who can possibly be surprised by this:
A key government witness has been barred from the trial of a Tanzanian man accused in a plot to bomb two U.S. embassies in Africa in 1998, delaying the case until next week.
Federal prosecutors want to call Hussein Abebe, another Tanzanian man, in the criminal case against Ahmed Khalfan Ghailani, the first detainee from Guantanamo Bay, Cuba, to face trial in the U.S.
Mr. Abebe has been expected to testify that he sold dynamite used in the bombing to Mr. Ghailani and that he believed Mr. Ghailani planned to use the explosives for mining.
Defense lawyers had argued that prosecutors learned Mr. Abebe’s identity as a result of statements made by Mr. Ghailani while he was in the custody of the Central Intelligence Agency. While in CIA custody, Mr. Ghailani was subject to so-called enhanced interrogation techniques, which his lawyers have said equated to torture.
Y'know, I take back what I said in the lede: I don't think Tweedle Dumb and Tweedle Dumber are surprised at all. I think this is exactly the outcome they intended from the beginning.
Really, what else could the judge do, no matter how much of a pinko he might be? Ghailani wasn't read his Miranda warning, wasn't given his phone call, etc., etc. He was treated as a captured enemy illegal combatant in a war, and was interrogated for intel entirely consistent with international law. Barry and Eric say he should have been treated as an ordinary civilian criminal defendant. So they take him out of Gitmo and the thrice congressionally approved military tribunal system and stick in him U.S. federal court like any other pursesnatcher, panhandler, or pickpocket, knowing full well that they can't convict him there. Now the prosecution's star witness is barred from testifying. No star witness testimony, no case.
Next step: The case is dismissed, and Ghailani walks. Think of it as a gesture of reparation to the "peace-loving Muslim world" for the horrible mistreatment that so many jihadis "ambassadors of Allah" disgracefully suffered at the Bushitler's bloodsoaked, war criminal hands.
The regime just won't turn him loose until after the election - which is undoubtedly when they wanted this ruling to have been issued as well.
Mark my words, you can count on more where this came from in the next two years. The direction his presidency is headed, The One will have less and less to lose by such motivational transparency.
