Robed Dominatrix Turns Sodomy Into Anal Rape

.....And the United States armed forces are supposed to just lay, um, forward and enjoy it:

A federal judge has issued a nationwide injunction stopping enforcement of the "don't ask, don't tell" policy, ending the military's seventeen-year-old ban on openly gay troops.

U.S. District Judge Virginia Phillips' landmark ruling Tuesday was widely cheered by gay rights organizations that credited her with getting accomplished what President Obama and Washington politics could not.

Note the two emphases.  Homosexual soldiers are not barred from serving; they simply must keep their retrograde "orientation" to themselves, just as the military cannot ask them about it.  In other words, sexuality is, by dint of official policy, irrelevant to military service.

But not anymore.  Now the standard-issue tiresome, arrogant, imperious, self-righteous, robed dictatrix has commanded that pole-smoking be not just relevant to military service, but its core driving justification.  And she's not leaving it for any higher authority to countermand or overrule.  You might even say she's.....taking the law into her own hands.

Commander Dyer throws down the gauntlet on just how outrageously and usurpatiously lawless this injunction really is:

Phillips is out on a limb with the ruling against a law passed by Congress; in no case should a lower-level district judge issue the final decision on the constitutionality of a federal law.  Americans have every right to expect that the weight of long precedent will preempt this decision’s practical effect until it has gone through the appeals process.

Phillips is also exceeding her authority in issuing a global injunction to the military.  Effectively, a district court judge can’t enforce an injunction on the whole Department of Defense.  Precedent and tradition aside, there is no means of doing so. The district court judge in Riverside can’t order a US Marshall to somehow enforce this ruling in Crystal City.  It’s a form of judicial shenanigans to issue an injunction under these conditions.

Phillips is taking judicial activism to its irresponsible extreme, and she needs to be slapped down by the check of the executive branch’s authority.

Boy, but that last phrase is a buzzkill.  Which brings us to Eeyore's prediction:

Decision time for The One: Does he appeal or not? If he decides not to, he’ll undercut Gates’s insistence that no action should be taken on the policy until the Pentagon completes its review of the effects on readiness. If he does appeal, he’ll antagonize the lefties (especially young voters) whom he needs to turn out next month. The obvious solution is to punt and avoid a decision until after the election, but I’m not sure liberals will let him get away with that. What if the “professional left” mobilizes and demands a decision before November 2? Prediction: Heart-ache at the Pentagon.

I wish I could argue the optimistic end of this, but I can't.  It's exactly the sort of thing on which Lucifer always votes "present".  Besides which, his "transformational" ambitions are predicated on eliminating due process of law.  Exit quote from Dyer:

Judge Phillips herself has provoked what must be recognized as a confrontation.  If she is allowed, by passive default, to reach outside the scope of her authority in this manner, the phrase “due process of law” will no longer have any meaning.
