Tell & Recruit - But Not Yet

Not very surprising, upon reflection:

The Obama administration on Wednesday asked a federal appeals court to immediately suspend a judge’s ruling that overturned the military’s “don’t ask, don’t tell” policy on gays.

The government says it wants the U.S. Court of Appeals for the 9th Circuit in San Francisco to take action on Wednesday. The federal government is preparing arguments for the appeals court on why the ruling on “don’t ask, don’t tell” should be suspended while the case is appealed.

The Obama administration says it is in favor of repealing the law. However, the government says that letting the ruling of U.S. District Judge Virginia Phillips to go forward immediately would be a major problem for the military.

That's not the problem it creates for The One.  He is, indeed, in favor of sodomizing the military; but if you think for one single, solitary moment that he's going to let some punk-ass, no-name federal judge usurp the "credit" for it, you don't know Barack Hussein Obama at all.  He doesn't share "glory" with ANYBODY.  As with everything else, this move for an injunction stay isn't about anything or anybody but him.

The Ninth Circuit's express lane response, however, did earn a double-take:

The 9th U.S. Circuit Court of Appeals on Wednesday granted the Obama administration’s request for a temporary freeze of a California-based federal judge’s order telling the military to stop enforcing the policy…

Government lawyers sought to suspend the ruling while appeals were pending, arguing that it would pose a major problem for the military. They said it could encourage service members to reveal their sexual orientation before the issue is fully decided.

In reality, that would be a very unlikely outcome.  Indeed, that was most of the reason why Judge Phillips tried to steal Barry's thunder on the matter.  Let's say her injunction had been upheld all the way to the SCOTUS (if the Regime had bucked it that far), and then the SCOTUS subsequently overturned her ruling in the actual case; in the mean time, aunties and jaspers would have been flooding into the ranks, knowing that the armed forces no longer existed to defend the country anymore.  With DADT reinstated, what would the Obamagon do with them?  Technically, they'd all have to be dishonorably discharged; practically, that would create a political and public relations firestorm as well as enormous logistical disruptions.

In other words, even if DADT were upheld, it would have been rendered functionally defunct.

Given Justice Anthony Kennedy's fondness for bun-duster trailblazing, that's where this debacle will likely end up anyway.  Capons and margies will just have to wait a little while longer to pound all our spears into French ticklers, and lavish their gratitude non-blasphemously.
